Competition Terms and conditions
1. These terms and conditions
1.1 These terms and conditions (“General Terms”) are the overarching general terms and conditions that apply to all competitions promoted by the Promoter (as defined below). All these competitions are referred to as the “Competitions” in these General Terms.
1.2 In addition to these General Terms, Competitions will also have their own specific terms and conditions (such as the details of how to enter, the opening/closing dates and the sort of prize you may win). Any such Competition specific terms and conditions will be made available as part of the promotion of the particular Competition in publications and/or online. In these General Terms, these Competition specific terms and conditions are referred to as the “Specific Terms”.
1.3 These General Terms should be read in combination with any applicable Specific Terms. Where any such Specific Terms conflict with these General Terms, the Specific Terms will take precedence.
1.4 The Promoter may change these General Terms at any time. You should check the Promoter’s website regularly for any changes, which will apply from the date that they are uploaded.
1.5 By entering any Competition you agree that you will be legally bound by these General Terms and also any applicable Specific Terms. Please see www.44foods.com for a copy of these terms and conditions.
2. The Promoter
2.1 The Promoter is: 44 Foods Limited (company number 12605532) whose registered office is Atlantic House, Oxleasow Road, Redditch, England, B98 0RE.
3. How to enter
3.1 All Competition entries must be received by the Promoter by no later than the closing date specified in the Specific Terms (“Closing Date”). Email entries are deemed to be received on arrival, not when they are sent from your email account. All Competition entries received after the Closing Date are automatically disqualified.
3.2 To enter the Competition complete and submit the online entry form provided on www.44foods.com by the Closing Date.
3.3 Prize draws are free to enter and no purchase is necessary.
3.4 The Promoter will not accept:
- responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
- proof of posting or transmission as proof of receipt of entry to any Competition.
3.5 Should you select the correct answer to the question from the multiple choice answers given you will automatically be entered into the prize draw from which the winner will be randomly selected from all of the correct entries into that particular prize draw.
4.1 Competitions are only open to UK residents (excluding Northern Ireland) aged 18 years or over, except:
(a) Employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 In entering any Competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the Competition.
4.3 The Promoter will not accept Competition entries that are:
- automatically generated by computer;
- completed by third parties or in bulk;
- illegible, have been altered, reconstructed, forged or tampered with;
- photocopies and not originals; or
4.4 There is a limit of one entry to each Competition per household. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.
5.0 The prize
5.1 There is no cash alternative for the prize and the prize is not negotiable or transferable.
5.2 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
6.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.
6.2 The Promoter will contact the winner using the telephone number or email address provided with the Competition entry within 28 days of the Closing Date. If the winner cannot be contacted or is not available or has not claimed their prize within 5 days of being notified, then the winner’s prize will be forfeited, and the Promoter will be entitled to select another winner in accordance with the process described above.
6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of prize winners on the website www.44foods.com.
6.4 If you object to any or all of your surname, county and winning entry being made available, please contact the Promoter by email at email@example.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
7. Claiming the prize
7.1 The prize will be despatched to the winner via UK mail service or email within 14 days of being notified of their win, unless stated otherwise. The Promoter will not be liable for any prizes which are lost, delayed or damaged in the post for reasons beyond it’s control.
7.2 The prize may not be claimed by a third party on your behalf.
7.3 The Promoter does not accept any responsibility if you are not able to take up the prize.
8. Limitation of liability
8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
9.0 Data protection and publicity
10.1If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
